The Court imposes on the perpetrator of the crime one more year for illegal possession of weapons and sentences four other defendants to three months for concealment.

The trial for the beating death with an American fist of the Irishman Carl Aidan Carr, 36, in September 2018 in Torrevieja, has been resolved this Wednesday in the Court in Elche with an agreement that has meant a significant reduction in the prison sentences that were initially requested after the agreement reached between the defenses,  the Prosecutor’s Office and the private prosecution. Thus, the material author of the crime, the Irishman Wayne Patrick W., defended by the lawyer Francisco Miguel Galiana Botella, has been sentenced to five years in prison for a crime of homicide and a further year for another crime of illegal possession of weapons – a pistol was seized – compared to the 15 and 3 years in prison that the accusations initially requested for each crime.

Four other defendants in the case, three of them defended by lawyers José Soler Martín, José Manuel Alamán and Andrés Morales, have been sentenced to three months in prison for concealment, compared to three years in prison that were initially requested for each one.

Both the Prosecutor’s Office and the private prosecution, exercised by the victim’s family, have admitted in their accusations that the mitigating circumstance of undue delay is applied  to all the defendants and those of drug addiction and reparation of damage in the case of the material author, since  he has paid before the trial 95,000 euros as compensation for the moral damages caused to Carl Aidan Carr’s mother. To that sum must be added another 5,000 euros that must be paid before March 20, according to the agreement reached, which has avoided a trial by popular jury.

Wayne Patrick W. will have to enter prison to serve his sentence between March 11 and 20. Precisely March 11 is the date of birth of the victim of the crime, whose body was buried in a rural area of the municipality of Rojales and was not discovered until four months after his disappearance.

The Irishman convicted of the crime has tried to apologize to the victim‘s mother, present in the courtroom of the Court in Elche, but she has not accepted them.

The five defendants have pleaded guilty before the magistrate handed down the sentence “in voce” and have acknowledged the facts contained in the writings of the Prosecutor’s Office and the private prosecution. The homicide occurred in the early hours of September 17, 2018 in a house in the La Siesta urbanization of Torrevieja, where the murdered Irishman, the defendant Wayne Patrick and a third defendant named Simon Mark F., who died in Ireland during the investigation of the case, lived.

“Sexual approaches”

Carl Aidan Carr and Simon Mark F. went to the house with three other women, including Wayne’s ex-girlfriend, with whom the victim ended up having a relationship on the sofa – “sexual approaches” she called it. This motivated Simon to go to a pub in Orihuela Costa where the ex-boyfriend was to tell him what happened and both returned to the Torrevieja flat.

Upon entering the house, Carl and Wayne’s ex-girlfriend were on the couch and a heated argument ensued. Then, with the intention of ending Carl’s life, Wayne hit the victim numerous times in the face with a brass knuckle and the other suspect who died in Ireland stabbed him several times, according to the accusation of the Prosecutor’s Office acknowledged by the defendant. Carl died from the blows, which caused “complex fractures of the facial massif”.

Once dead, Wayne Patrick and Simon Mark contacted one of the accused of cover-up, cleaned the remains of blood in the house and took the body in a car to a plot of land in Rojales, where they buried the body.

In the dock have also sat three women accused of cover-up, including Wayne’s ex-girlfriend who triggered the deadly attack. This woman knew that her ex-partner had killed Carl, but in her first statement to the Civil Guard she offered a false version with the intention that Wayne would not be investigated.

Another of the women convicted of concealment provided a false alibi to Wayne Patrick, saying that on the night of the crime he was with her in a pub in Orihuela Costa and later at her home, where he stayed overnight and left the next day in the afternoon.

The third woman convicted of concealment offered the Civil Guard a false version to provide an alibi to Wayne’s ex-girlfriend and said that she did not enter the house where Carl Aidan Carr was beaten to death.
