The Court of Alicante has acquitted three defendants of sexually assaulting a 25-year-old man with a broomstick in Els Poblets on the grounds that the facts attributed to three relatives of a 14-year-old minor, the complainant’s ex-girlfriend, have not been accredited, as stated in a sentence issued by the Third Section. The defendants were the father of the minor, her brother and her son-in-law.
The acquitted defendants, two of them defended by the lawyer Francisco Miguel Galiana Botellaand the other by Alexander Stefan Rodenkirchen, faced a request from the Prosecutor’s Office for eleven years in prison for each for the crime of sexual assault and have also been exonerated of two minor crimes of injuries and damages as they were considered to be prescribed. as the defense alleged.
The facts declared proven in the judgment date back to the end of 2020. The complainant was a 25-year-old man who lived in Tomelloso and was denounced in turn for sexual abuse by the father of a minor under 14 years of age, with whom he had a relationship, which caused a restraining order to be agreed. The father did not approve of this relationship and the young man moved with “dubious purpose” from Tomelloso to Els Poblets, where the minor’s father lived.

He arrived at one o’clock in the morning on November 6, 2020 and entered the father’s home, without the court considering it proven that the accused parent was waiting for his arrival. Then the other two defendants entered and pounced on the young man. Nor does the Court consider it proven that the three defendants immobilized the young man, pulled down his pants and inserted a broomstick into his anus while insulting him and threatening him with death.
That same morning, the father called the Civil Guard of El Verger to report a robbery at his home, where they were holding the young man from Tomelloso. The young man, when he was transferred to the premises of the Civil Guard, told the agents that he had been sexually assaulted with a stick and maintained the same version that same day in the court of Instruction number 2 of Dénia.
However, the sentence adds that on November 9 the complainant voluntarily changed his statement and said that he was only assaulted by the father of the minor and that they did not insert a stick up his ass or break his mobile phone. In this same sense, he spoke in the oral hearing held recently at the Court of Alicante, where he pointed out that he was invented that he had been impaled out of fear and as revenge after being denounced for abuse by the father of the minor by not consenting to the relationship with his daughter.

One of the injuries that the young man presented was an anal fissure whose origin is not proven, according to the Court. The defense lawyers provided an expert report, in which the well-known doctor Luis Frontela -who intervened in the case of the three girls from Alcàsser-, participated, where it was concluded that the complainant “did not suffer the introduction of any foreign body into the rectum through the anus, and of course, not, the introduction of a stick”. as indicated in the sentence. Likewise, the defense experts were inclined to relate the fissure in the anal mucosa with the existence of hemorrhoids.
